论网络个人信息保护中“用户同意”的约束力--以同意收集个人信息为例

摘　　要：在网络个人信息保护中,“用户同意”兼具消极防御和积极利用的功能。目前“用户同意”流于形式,致使其预设功能难以发挥作用。直接以网络用户点击“同意”按钮为由,认为其应受《个人信息保护政策》的约束并不妥当。“用户同意”一方面为网络服务提供者的信息收集行为解禁,另一方面也为其设限。对收集者的同意,是对特定网络服务提供者的解禁行为,网络用户应受其同意的约束,容忍该网络服务提供者的信息收集行为。对收集范围的同意,为网络服务提供者的信息收集行为设定了边界,网络服务提供者在提供服务的目的范围内收集用户个人信息,网络用户才受其同意的约束。提供服务的目的范围,由法院在个案中确定。In the protection of personal information on the Internet,“User Consent”has the functions of both passive defense and active use.At present,“User Consent”is merely a form,making it difficult to perform its preset functions.It is improper to think that network should be bound by the“Personal Information Protection Policy”directly on the grounds that he clicks the“Agree”button.“User Consent”on the one hand lifts the ban on information collection behavior of network service providers,and on the other hand sets restrictions on it.The consent of the collector is an act of lifting the ban on a specific network service provider,and network user shall be bound by his consent and tolerate the information collection behavior of the network service provider.The consent to the scope of collection sets the boundary for the information collection behavior of the network service provider.Only when the network service provider collects the user’s personal information within the scope of the purpose of providing the service,is the network user bound by his consent.The scope of the purpose of providing services shall be determined by the court in a case.
