论工会在环境治理中的作用及其法治保障

摘　　要：党的十八大将生态文明建设纳入“五位一体”总体布局,党的十九大报告进而提出要构建由政府主导的环境治理体系。2020年中共中央办公厅、国务院办公厅印发的《关于构建现代环境治理体系的指导意见》进一步明确提出,要发挥工会等各类社会团体在环境治理中的作用。发挥工会在环境治理中的作用并强化其法律保障,不仅是解决人民对美好生态环境的需求不断增强与生态环境监管能力相对有限之间矛盾的现实需求,也符合《环境保护法》的根本精神,更是实现生态领域国家治理体系现代化的重要体现,其本质是社会自我规制,其根本目的是构建“内生动力型”环境守法机制。为更好地发挥工会在环境治理中的作用,应采用助推机制,即构建对于用人单位和职工而言激励相容的机制,并由国家为其提供法律制度保障。The Eighteenth National Congress of the CPC decides to promote balanced economic,political,cultural,social,and ecological progress,and the Nineteenth decides to set up the ecological governance framework with the government at its heart.The guideline on establishment of the environmental governance framework published by the central government stipulates that social organization such as the Trade Union needs to play a part in environmental governance.To legislate on that issue is not only necessary to relax the conflicts between the peoples′increasing requirement of environment quality and the limited environmental implementation capacity,and to meet the requirements of the Environmental Protection Act,but also the reflections of modernization of environmental governance.In essence,it is the social self-regulation,to promote the endogenous driving force of environmental compliance.To realize that target,it is indispensable that the nudges mechanism and finds the compatible incentive,and gives a legislative framework.
