专业法官会议的困境检视与完善路径

摘　　要：专业法官会议在提高法官办案能力、降低职业风险、统一裁判尺度、总结审判经验等方面有着积极作用。但是,由于运行机制尚未成熟、形式化倾向严重、行政色彩较浓,加之一些法院领导和办案法官对其必要性认识不足、相应的配套保障机制尚不完善,我国现行专业法官会议一直没有发挥出司法改革顶层设计所期待的作用。为了严格落实"让审理者裁判、由裁判者负责"的司法理念,保障裁判结论的专业性、科学性,可以通过提升专业法官会议的法律地位、准确把握专业法官会议的定位和目标、在专业法官会议中贯彻意见交换和辩论原则、明确专业法官会议个案讨论范围、充分运用网络信息技术保障会议科学规范等措施,进一步改革和完善现行的专业法官会议制度。Professional judge conferences have an active role in improving judges’ability to handle cases,reducing professional risks,unifying the standard of judges,and summarizing trial experience.However,due to the immature operation mechanism of the current professional judge conference,the formalization tendency,the relatively strong administrative color and inadequate understanding of the significance of meetings by leaders of the courts at all levels and judges handling the case,the professional judge conference system failed to play the role intended by the top-level design of judicial reform.The fundamental path to the perfection of the professional judge conference system lies in improving the legal status of the professional judge conference,optimizing the system construction and accurate the positioning of the professional judge conference,implementing the rules of opinion exchange and debate in the professional judges meeting,clarifying the scope of the professional judges meeting discussion,and ensuring scientific and standardized meetings through Internet and information technologies.The reform of and perfection of the professional judge conference system will contribute to the implementation of the judicial concept of"let the adjudicator judges and the judge takes responsibility".
