摘 要:应急管理是从“风险过程控制”的角度,对风险和危机事前、事中、事后各环节的管理。突发传染病应急管理能力的提升,离不开法律规则的指引和规范。目前我国已初步建立了突发传染病应急管理的法律体系,但各个“应急法”都存在自身不足和适用冲突。《传染病防治法》(征求意见稿)尽管作出了很多调整,但突发传染病应急管理事前、事中、事后各阶段仍存在立法的缺陷,比如传染病分类管理不合理、疫情信息传导不通畅、权利保障不到位、应急解除不明确等问题。我国应进一步完善相关法律制度,从改进传染病病种分类管理、规范疫情信息传导、合理界定防控对象、统一应急解除条件等方面作出系统性调整。Emergency management aims at easing risks by controlling its“transmission process”.The improvement of emergency management of unexpected infectious diseases needs legal regulations’references and control.In China,legal system on the emergency management of unexpected infectious diseases has been built preliminarily,but various emergency regulations have its own defects and conflicts for application.Unexpected Infectious disease related legislation has defects in this three phases:beforehand prevention,processing actions and post control,such as inappropriate classification of infectious diseases,inconsistent transmission of infectious diseases information,deficient safeguard methods in terms of rights,ambiguous conditions on the termination of emergency.Relative regulations should be revised timely and systematically as follows:adjust classification of infectious diseases,stipulate the transmission of infectious diseases,rationally redefine the prevention and control objects,unify the conditions on the termination of emergency,etc.
