论公平参与权及其权利哲学基础和价值实现手段

摘　　要：公平参与权是一项保证参与者公平参与竞赛对抗的权利。公平参与权是自然权利的衍生权利,以参与权和公平权为权利成分,以自由权和尊严权为权利基础。它来源于游戏与竞赛,以公平为实质价值,对竞赛对抗施加规制,保护对抗参与者的生命权和健康权。对抗中的作弊行为摧毁了竞赛对抗的存在基础,破坏了对抗环境,使对抗不再成为促进人类进步的驱动力。作弊行为在给自己带来利益的同时摧毁了他人通过对抗获得的成果,是对他人尊严权的侵害。公平参与权以系统化平等为目标,同时,亦作为价值标准限制介入对抗的公权力作弊。自律是实现实质公平的唯一途径,公平价值的实现不依赖公权力做出裁判,而依赖参与者自律维护公平的对抗环境,通过公平参与对抗实现共同获益。公平参与权将人身权、尊严权和自律原则相结合,是人权精神的写照。Equitable Participation Right is a right to ensure that participants participate in the competition fairly.Equitable Participation Right is a derivative right of natural rights.It is composed of Participation right and Equitable right,and is based on the right of freedom and the right of dignity.It comes from games and competitions.It takes fairness as the substantive value,regulates the competition confrontation and protects the life right and health right of the participants.Cheating ruins the external environment of fair competition and makes it no longer a driving force to promote human progress.Cheating not only brings benefits to itself,but also destroys the achievements obtained by others through competition,which is an infringement on the dignity of others.equitable participation right aims at systematic equality;it also serves as a value standard to limit the authorities cheating involved in confrontation.Self-discipline is the only way to achieve substantive equity.The realization of equitable value does not rely on authorities to make judgments,but relies on self-discipline of participants to maintain a fair competition environment and achieve common benefits through equitable participation in competition.The equitable participation right combines personal rights,dignity rights and self-discipline principles,which is the reflection of human rights spirit.
