摘 要:在厘清相关概念的基础上,梳理出目前我国科技计划项目监督立法在国家层面和地方层面的现状,介绍国外有关科技监督立法经验,深入剖析我国现行科技监督立法存在体系性缺乏、效力层级低、约束力不足等问题,并以《广东省科技计划项目监督规定》为立法样本,从立法内容、立法特色等角度总结分析广东省科技计划项目监督地方立法的实践价值。据此,提出完善和优化我国科技计划项目监督立法体系的对策建议,包括出台专门科技计划项目监督法规、加强配套政策衔接、强化粤港澳大湾区跨境科技计划项目监督等,为进一步完善我国创新驱动发展的法治保障提供参考。On the basis of clarifying the relevant concepts,this paper concludes the present situation of science and technology planning project supervision legislation in China at the national and local level separately,introduces the experience of foreign science and technology supervision legislation,and by taking Regulations on Supervision of Science and Technology Planning Projects of Guangdong Province as the legislative sample,summarizes and analyzes the practical value of local legislation of science and technology supervision in Guangdong from the angle of legislative content and legislative characteristics.Based on this,the paper puts forward some countermeasures and suggestions to perfect and optimize the legislative system of science and technology supervision in China,including introducing special science and technology plan project supervision legislation,strengthening supporting policy convergence,strengthening cross-border science and technology planning project supervision of Guangdong-Hong Kong-Macao Greater Bay Area,etc.,in order to provide reference for further improving the innovation-driven legislation in China.
