移动服务的版权问题与图书馆的自律性版权保护对策

摘　　要：基于移动图书馆服务的数字资源具有资源形态的碎片化、权利主体的大众化和传播范围的广域化等重要特征。图书馆对移动服务数字资源的组织、加工和传播服务涉及版权精神权利、版权财产权利和版权技术措施权的保护问题。图书馆应重视从自律角度采取措施防范与化解移动服务的侵权责任风险,包括认真遵守版权法律法规、开展合同模式下的版权管理、促进版权管理技术的迭代升级、推动版权风险评估的常态化、寻求版权管理的专业化指导等。Digital resources based on mobile library services have such important features as fragmentation of resource forms,popularization of rights subjects and wide dissemination. Library’s organization,processing and dissemination of mobile service digital resources involve the protection of copyright moral rights,copyright property rights and copyright technical measures. Libraries should pay attention to taking measures to prevent and resolve the infringement liability risks of mobile services from the perspective of self-regulation,including serious compliance with copyright laws and regulations,copyright management under the contract mode,promoting the iterative upgrade of copyright management technology,promoting the normalization of copyright risk assessment,and seeking professional guidance on copyright management,etc.
