摘　　要：监察法律关系应为一种特殊的法律关系,《监察法》是监察法律关系产生的重要依据。研究监察法律关系的运行过程及其内涵,是完善监察法治建设的现实迫切需要,也是法学界应予密切关注的重要议题。国家监察法律关系的建构与完善,要运用法治理念、法治思维、法治方式创制中国特色、中国风格、中国气派的监察法律关系理论。深化监察法律关系理论构建及内涵的研究,有利于为健全监察法律制度体系、优化监察法律环境提供理论支撑,以利于推进国家监察制度实现法治化、体系化、科学化。The legal relationship of supervision should be a special one.Supervision Law is an important basis for the emergence of supervision legal relationship.It is an urgent need to study the operation process and connotation of the legal relationship of supervision,which is also an important issue to which close attention should be attached by the jurisprudential circle.In order to construct and perfect the legal relationship of state supervision,we should use the concept,the thinking and the approach of rule of law to create the theory of supervision legal relationship with Chinese characteristics,style and manner.Deepening the research on the legal relationship of supervision is conducive to providing theoretical support for improving the legal system of supervision and optimizing the legal environment of supervision,and to promoting the legalization,systematization and scientization of the national supervision system.
