摘　　要：涉外定牌加工是国际进出口贸易的常见方式。就涉外定牌加工中的商标使用认定问题而言,不管是在司法认定逻辑还是在理论逻辑研究上仍存在争议性。在规范语境下分析,商标的地域性是引发涉外定牌加工存在商标使用争议的特征性焦点。检视纠纷裁判逻辑,商标使用的认定问题集中在认定条件与使用主体方面仍需进一步的法理厘清。基于涉外定牌加工的框架,从纠纷裁判逻辑的角度进行制度与规范的导正与重构,厘清商标使用的条件、对商标识别功能的理性矫正以及明晰商标使用在商标制度中的作用。Foreign licensing processing is a common way of international import and export trade.As far as the identification of trademark use in the process of foreign-related licensing,there are still controversies in the logic of judicial identification and theoretical logic research.In the normative context,the regional nature of trademark is the characteristic focus that causes the dispute over trademark use in the process of foreign licensing.Examining the logic of dispute adjudication,it is seen that the identification of trademark use focuses on the conditions of identification and the subject of use.Based on the framework of foreign licensing processing,the system and norms are guided and reconstructed from the perspective of dispute adjudication logic,and the conditions of trademark use,the rational correction of trademark recognition function and the role of trademark use in trademark system are clarified.
