摘 要:停车位的权属判定标准一直是理论和实务中争论激烈的一个话题,但由于立法的含糊其辞,使得各地关于停车位权属的认定大相径庭,并且有愈演愈烈的趋势。目前,主流关于停车位权属的判断有以下几种观点:以是否计入建筑容积率为标准、以是否计入公摊面积为标准、以是否计入公摊和容积率为双重标准等。但以上观点都存在固有的缺陷,不能彻底解决停车位权属问题。随着空间权理论的发展与空间建设使用权概念的引入,可以为停车位权属问题的判断及制度构建提供一些解决思路。The judgment standard of parking space ownership has always been a hot topic in theory and practice.However,due to the vagueness of legislation,the identification of parking space ownership has been widely different in different regions,and the trend is getting more and more intense.At present,the mainstream judgment on the ownership of parking space has the following views:whether it is included in the building plot ratio as the standard,whether it is included in the shared area as the standard,whether it is included in the shared area as the double standard,and so on.However,there are inherent defects in the above viewpoints,which cannot completely solve the problem of parking space ownership.The development of space right theory and the introduction of the concept of space construction right can provide some solutions for the judgment and system construction of parking space right.
