论废止死刑与加重生刑的关系

摘　　要：从世界范围内来看,关于废止死刑与加重生刑关系问题的处理,存在着两种不同的模式,即废止死刑的同时不加重生刑的模式和废止死刑的同时加重生刑的模式。出于对我国刑罚结构所存在的“死刑过重、生刑过轻”问题的认识,我国《刑法》在废止部分死刑罪名的同时采取了多项加重生刑的措施。在分阶段、逐步废止死刑的路径下,以减少死刑立即执行为目的加重生刑,以弥补部分犯罪的生刑与死刑之间的刑罚空档,具有合理性。当前长期监禁刑的设置具有相对合理性;从推动死刑完全废止的角度看,加重部分犯罪的生刑具有合理性;不得减刑、假释的终身监禁不宜被扩大适用。In the world,there are two different modes to deal with the relationship between abolishing death penalty and aggravating imprisonment:the mode of abolishing death penalty without aggravating imprisonment,and the mode of aggravating imprisonment while abolishing death penalty.Based on the understanding of the problem that death penalty is too heavy and imprisonment is too light in China's penalty framework,China's criminal law has adopted a number of measures to aggravate imprisonment while abolishing some death penalty charges.Under the path of phased and gradual abolition of death penalty,it is reasonable to aggravate imprisonment in order to reduce the application of immediate execution of death penalty,so as to make up for the penalty gap between imprisonment and death penalty for some crimes.At present,the setting of long-term imprisonment is relatively reasonable;from the perspective of promoting the complete abolition of death penalty,it is reasonable to aggravate imprisonment of some crimes;and the application scope of life imprisonment without commutation or parole should not be expanded.
