分治视角下村委会与村集体经济组织关系探究

摘　　要：乡村治理体系作为乡村治理体系现代化的制度基础,其有机搭建要以村委会和村集体经济组织间的相互巩固与支持样态为本位。随着传统政经合一体制的稳态格局被打破,集体经济组织虚置、村级组织侵权越权问题凸显,客观上对重塑乡村治理形态和分离乡村组织功能提出新诉求。可适时适度通过成员分离、组织分离、权责分离等路径实现分治,从而实现村委会与村集体经济组织高效运转。The rural governance system is the institutional basis for the modernization of itself,and its organic construction should be based on the mutual consolidation and support between the village committee and the collective economic organizations of the village.As the steady state structure of the traditional integration of politics and economy has been broken,the problems of the virtual establishment of collective economic organizations and the ultra vires infringement of village level organizations have become prominent,which objectively puts forward new demands for reshaping the rural governance form and separating the functions of rural organizations.In order to realize the efficient operation of the village committee and the collective economic organizations of the village,we can achieve the separation of governance in a timely and appropriate manner through the separation of members,separation of organizations,separation of power and responsibilities.
