摘　　要：从1988年至今,中国参与联合国维持和平行动已超过30多年,目前中国也是联合国安全理事会五个常任理事国中最大的维和出兵国与出警国。在过去的30多年中,中国通过参与联合国维持和平行动为维持世界和平与国际安全作出了巨大贡献。与此同时,在参与联合国维持和平行动的理论与实践方面也都有相当多的积累。为了进一步增强参与行为的合法性和正当性,提高参与行动的效能,更加充分地发挥参与联合国维持和平行动在维持世界和平与国际安全,以及维护中国国家利益方面的积极作用,对中国参加联合国维持和平行动的国际法基础进行系统和全面的分析,无疑既具有突出的理论价值,又具有重要的实践意义。中国参加联合国维持和平行动的国际法基础呈现出多样性和层次性,多样性主要取决于调整关系的领域和类型,而国际法基础的层次性则主要取决于调整关系的等级,并相应地分为宏观、中观和微观等三个层面。It is over 30 years up till now since China participated for the first time in the United Nations Peacekeeping Operations in 1988, and at present China is the largest contributor of troops and civil police among the Five Permanent Members of the United Nations Security Council. In the past 30 years, China has made great contributions to the maintenance of world peace and international security through its participation in UN peacekeeping operations. At the same time, China has accumulated considerable theoretical and practical experience in participating in UN peacekeeping operations.In order to further enhance the legitimacy of participation, improve the effectiveness of participation in operations, and give full play to participation in UN peacekeeping operations in maintaining world peace and international security, As well as the positive role in safeguarding China’s national interests, a systematic and comprehensive analysis of the international legal basis for China’s participation in UN peacekeeping operations is of outstanding theoretical value and important practical significance. The international law basis for China’s participation in UN peacekeeping operations presents diversity and hierarchy. The diversity mainly depends on the fields and types of adjustment relations,while the level of international law basis mainly depends on the level of adjustment relations, which can be divided into three levels: macro level, medium level level and micro level.
