区块链在国际商事仲裁中的运用、困境与解决路径

摘　　要：区块链作为一种前沿的基础设施技术,能够在跨境电子商务、跨境电子取证、跨境线上执行等方面与国际商事仲裁实现良好的对接,将国际商事仲裁的仲裁员从事实认定中解脱出来,提高国际商事仲裁的效率,并保证国际商事仲裁的安全。但区块链在国际商事仲裁的运用存在困境,目前没有相关的法律来规制区块链的司法运用,给数据安全、个人隐私保护带来风险;且区块链在国际商事仲裁中还存在法律适用上的困难,给仲裁地、仲裁协议效力等传统国际商事仲裁法律制度带来挑战。我国在国际商事纠纷解决的竞争力上并不强,我们应提升我国国际商事纠纷解决能力,对国际商事仲裁持包容态度,促进区块链在国际商事仲裁中的运用,并对现有的国际商事仲裁制度进行改革,建立临时仲裁制度,同时制定符合"智慧监管"要求的区块链法律监管制度,一方面既要促进区块链在国际商事仲裁中的运用,另一方面也应使区块链在国际商事仲裁中的运用可防可控,实现区块链技术与国际商事仲裁制度的完美结合。As a cutting-edge infrastructure technology, block chain effectively coordinates with international commercial arbitration in cross-border e-commerce, cross-border e-forensics, cross-border online execution, etc., which frees arbitrator of international commercial arbitration from fact finding, increases the efficiency of international commercial arbitration and guarantees the security of international commercial arbitration. However, block chain faces a dilemma in application in international commercial arbitration. Currently, there is no single rule to regulate the judicial application of block chain, which causes risks to data security and privacy protection. In addition, difficulties resulted from application of law are also inevitable, and it brings challenge to traditional international commercial arbitration legal system such as the place of arbitration, the effect of arbitration agreement, etc. China is weak in competitiveness of international commercial dispute settlement, so we have to take an inclusive attitude towards international commercial arbitration to increase our ability of international commercial dispute settlement. Furthermore, it is necessary to promote the application of block chain in international commercial arbitration, reform the current international commercial arbitration system, establish ad hoc arbitration system, and enact block chain legal supervision regulations in accordance with the requirement of "intelligent supervision". The application of block chain in international commercial arbitration should be encouraged. At the same time, the application of block chain in international commercial arbitration should be put under control to realize a perfect combination between block chain technology and international commercial arbitration system.
