摘  要:中央有关农村土地制度的改革日益深化,主要表现为:在坚持农村土地集体所有的前提下,实行土地所有权、承包权、经营权三权分置并行,经营权可以单独进行流转。土地经营权作为财产性权利可以单独流转,就涉及到当事人在取得土地经营权时是否适用物权法中的善意取得制度。通过厘清农村承包土地经营权的性质,明确土地经营权可以适用善意取得制度,进而分析土地经营权取得可适用善意取得制度的具体条件,有助于我们更深入地认识承包土地经营权,更好地行使该项权利。The central government’s policy on the reform of rural land system is deepening day by day.Under the premise of collective ownership of land,the three rights of ownership,contract right and management right can be separated,and the management right can be transferred separately.As a property right,the right of management can be transferred separately,which involves whether the parties apply the system of Bona Fide Acquisition in the property law when they obtain the right of management.By clarifying the nature of rural contracted land management right,this paper makes clear that the land management right can be applied to the system of Bona Fide Acquisition,and analyzes the specific conditions under which the acquisition of land management right can be applied to the system of acquisition in good faith.The solution of this series of problems will help us to have a deeper understanding of the right of contracted land management and better exercise this right in practice.
