环评区域限批制度的规范演进、法理解析与制度应对

摘　　要：我国环评区域限批制度刚刚经历了前法制化时期的制度试错阶段,并以新《环境保护法》第四十四条的一般规定为拐点逐渐步入以立法规范实践的法制化进程。环评区域限批行为是一种兼具内部与外部、具象与抽象的行政权力行使的全新方式,其以区域整体为调整对象,依循“区域污染——区域担责”的宏观整体规制理路,将整个区域视为对外连带的环境责任共同体。当前我国实践应用中的环评区域限批表现出极大的随意性,现实需要与制度供给间的张力普遍存在。国家应尽快出台相关配套立法,逐步完善环评区域限批的适用情形、启动主体、调整对象、启动程序、适用期限、终止程序、救济路径等制度内容。China′s regional restricted approval system of environmental impact assessment has just gone through the trial and error stage in the pre-legalization period, and gradually stepped into the legalization process of standardizing the practice by legislation with the general provisions of Article 44 of the new Environmental Protection Law as the turning point. Regional restricted approval system of environmental impact assessment approval restriction is a new way of administrative power exercise, which is both internal and external, concrete and abstract. It takes the whole region as the adjustment object, follows the macro and overall regulation of "regional pollution--regional responsibility", and regards the whole region as an external joint and several community of environmental responsibility. At present, the regional restricted approval system of environmental impact assessment in China′s practical application shows great arbitrariness, and the tension between actual demand and institutional supply is universal. It is necessary to introduce relevant supporting legislation as soon as possible, and gradually improve the system contents such as the applicable situation, the initiation of subject, the adjustment of object, the initiation procedure, the applicable period, the termination procedure and the relief routes of the regional restricted approval system of environmental impact assessment.
