摘　　要：董必武同志是新中国法治的重要奠基者之一,在“八大”上的发言是他探索马克思主义法学同中国法治建设具体实践相结合所做出的重要理论贡献,代表了中国共产党在新中国前三十年的社会主义法治建设道路上艰苦探索获得的重要成果,也是毛泽东思想的重要组成部分。在这一重要发言中,董必武同志提出并系统阐述了“依法办事”“有法可依”“有法必依”等法制方针,加强党对法治工作的领导与党组织、党员“依法办事”统一的法制原则,以及通过加强党的纪律检查和纪律教育促进人民民主法制等一系列重要思想,这些思想为邓小平同志的民主法制思想乃至新时代全面“依法治国”的理论和伟大实践奠定了基础,产生了深远的影响。Dong Biwu is one of the important founders of the rule of law in the new China.His speech at the the 8th National Congress of the CPC is an important theoretical contribution he made in exploring the combination of Marxist law with the specific practice of the rule of law in China.The speech represents an important achievement the Communist Party of China has been obtained,in its painstaking exploration of the socialist rule of law construction in the first 30 years of the People’s Republic of China and it is also an important part of Mao Zedong Thought.In this important speech,Dong Biwu proposed and systematically expounded three legal principles,that is,“act according to law”,“where there are laws to be followed”,and“where there are laws that must be followed”.The speech strengthened the CPC’s leadership over work of the rule of law,and unified legal principles of the CPC organizations and the CPC members by“act according to law”,and a series of other important thoughts such as strengthening the CPC’s discipline inspection and disciplinary education to promote people’s democracy and legal system.These thoughts laid the foundation for Deng Xiaoping’s democratic legal system thoughts,and even the theory and great practice of“ruling the country by law”in the new era,and have had a profound impact.
