摘  要:东南亚海域恐怖组织的频繁活动已经对中国与东盟各国构成重大的潜在威胁,严重影响到我国与东盟国家的共同利益。我国与东盟已在刑事司法实践中开展了广泛的交流与合作,但现有刑事区域合作法律框架不完善,缺乏规制海上恐怖主义犯罪的针对性法律,东南亚海域各国刑事法治水平差异较大,严重制约着海上反恐刑事合作机制的发展与完善。中国与东盟应当在平等协商、循序渐进的原则下适当让渡刑事司法权并明确海上恐怖主义犯罪管辖权,探索建立专职独立的海上安全刑事合作中心及一体化海上安全刑事防治机制。我国亦应及时在刑事司法体系中作出应对措施。The frequent activities of terrorist organizations in Southeast Asia have posed a great potential threat to China and ASEAN countries and seriously affected their common interests.They have carried out extensive exchanges and cooperation in criminal justice practice,but the existing legal framework of criminal regional cooperation is not perfect,and there is a lack of targeted laws to regulate maritime terrorist crimes.The level of criminal law ruling in Southeast Asian countries is quite different,which seriously restricts the development and improvement of maritime anti-terrorism criminal cooperation mechanism.China and ASEAN should,on the principle of equal consultation and gradual progress,appropriately transfer criminal jurisdiction and clarify the jurisdiction of maritime terrorism crime,and explore the establishment of a full-time and independent criminal cooperation center for maritime security,an integrated criminal prevention,and control mechanism for maritime security.China should also take timely measures in the criminal justice system.
