从四十年最高检《工作报告》看我国检察文明的发展过程——以检察权为考察对象

摘　　要：1980年—2019年间四十份《最高人民检察院工作报告》见证了我国检察文明发展的历程。而检察文明的发展和体现,有赖于检察权的实际运行。通过分析历年《最高人民检察院工作报告》,可将检察文明四十年的发展划分为四个阶段。第一阶段,检察机关恢复重建,工作的重心主要放在维护社会治安、打击经济犯罪。第二阶段,检察权运行除体现在常规犯罪打击外,更在其他职能领域开始完善职权的行使。第三阶段,检察权运行的主题为"强化监督,打击贪污贿赂犯罪"。第四阶段,在检察文明已发展到一定程度时,工作重点则放在队伍自身建设等自我提升部分,以适应法治社会对司法人员要求。通过总结可以发现,检察文明日后的发展主要应体现在深入开展机构改革,适应国家权力结构的变化,以及继续强化队伍建设,加强自身监督,接受人民监督。Forty Supreme People's Procuratorate Work Reports from 1980 to 2019 witnessed the development of China's Prosecutorial civilization.The development and manifestation of the Prosecutorial civilization depends on the actual operation of the procuratorial power.By analyzing Supreme People's Procuratorate Work Reports over the years,the development of Prosecutorial civilization for 40 years can be divided into four stages.In the first stage,the procuratorate resumed and reconstrcted,and the focus of the work was mainly on maintaining public security and combating economic crimes.In the second stage,in addition to the conventional crime strikes,the procuratorial power operation began to improve the exercise of powers in other functional areas.In the third stage,the theme of the operation of the procuratorial power is“strengthening supervision and combating corruption and bribery crimes”.In the fourth stage,when the procuratorial civilization has developed to a certain extent,the focus of work is on the self-improvement part of the team's own construction,in order to adapt to the requirements of the judiciary in the rule of law society.Through summarization,it can be found that the future development of the procuratorate civilization should be mainly reflected in the in-depth institutional reform,adaptation to changes in the state power structure,and continued strengthening of team building,strengthening of its own supervision,and acceptance of the people's supervision.
