摘　　要：红十字国际委员会作为具有法律人格的特殊国际组织,不仅在国际性武装冲突中发挥重要作用,在非国际性武装冲突中也扮演着重要角色。1949年,日内瓦四公约及其两个附加议定书明确了红十字国际委员会在非国际性武装冲突中拥有开展人道主义活动、享受活动便利、得到尊重和保护的权利,也规定了其开展工作时应遵守的义务。在非国际性武装冲突中,红十字国际委员会必须在保持中立、公正和独立原则下与冲突各方开展合作。当前,世界上很多国家通过国内立法的方式将红十字国际委员会直接纳入其国内法的管辖范围,具有一定的借鉴意义。As a special international organization with legal personality,ICRC plays an important role in international and non-international armed conflicts.The Geneva Conventions and their additional protocols clarify that ICRC has the right to carry out humanitarian activities,enjoy the convenience of activities,and its staff and objects should be respected and protected in non-international armed conflicts.They also stipulate the obligations of ICRC when it conducts humanitarian activities.ICRC should cooperate with all parties to the conflict under the principles of neutrality,impartiality and independence.At present,many countries have adopted domestic legislation to bring the ICRC directly into the jurisdiction of their domestic laws,which has certain referential significance for us.
