摘　　要：当下司法改革甚或整个法治中国建设迫切需要从传统司法文化中寻求出能够塑造其主体性的文化涵养,以体现中国法治建设的特色性、自主性和中国性。和合司法与现代多元化纠纷解决机制的理性选择、情理司法与现代司法裁决的合理性和可接受性、仁道司法与现代刑罚人道主义以及宣教司法与通过司法判决的公众法治观念塑造都有着密切的价值关联。传统司法文化与当代法治中国建设进行对接的本质就在于挖掘传统司法文化背后的超时空价值,最为关键的是在对其进行识别的基础上开辟出创造性转化和创新性发展的路径。但是,在未来的研究中,依然需要处理好以下两个重要问题:一是既要抓住文化识别和创造转化两个重要方向,又要打破各种现实障碍;二是警惕传统司法文化中的泛道德主义话语。At present,judicial reform or even the construction of the rule of law in China urgently needs to seek from the traditional judicial culture that can shape its subjectivity to reflect the characteristics,autonomy and Chineseness of the construction of the rule of law in China.The harmonious justice and the rational choice of modern diversified dispute resolution mechanisms,the reasonable justice and the acceptability of modern judicial adjudication,the benevolent justice,and modern criminal humanitarianism,as well as the missionary justice and the shaping of the public conception of rule of law through judicial judgments are all closely related to value.The essence of the docking between traditional judicial culture and the construction of contemporary rule of law in China is to tap the beyond time and space value behind the traditional judicial culture.The most important thing is to open up creative transformation and innovative development paths based on identifying them.However,in future research,the following two important issues still need to be addressed:one is to grasp the two important directions of cultural identification and creative transformation,and to break various practical obstacles;the other is to be wary of the pan-moralism discourse in traditional judicial culture.
