信用国际化——人民币国际化法制建设的理据与重心

摘　　要：人民币国际化只有具备能够满足其需要的法律制度才能实现。识别和建构这样的法律制度,需要建立应有的法理依据及由此确立法制建设的重心。由于人民币国际化所需法制是人民币国际化的本质需要在法上的体现,故人民币国际化法制建设的理论指引及重心需从人民币国际化本质中寻求。在当今货币采用信用本位的时代,人民币在本质上是国家信用,人民币国际化的实现需要国际社会的自愿接受而非依靠法律的强制,因此,人民币国际化实质上是人民币信用的国际化。对此,货币金属理论和货币国家理论均无法予以解释或提供支持。而强调社会选择的货币社会理论,虽能潜在地用于诠释货币在国际间使用的货币现象,因而可成为人民币国际化法制建设的重要理论依靠,但仍需发展和构筑。鉴此,我们应将维护人民币信用作为人民币国际化法制建设的指针,将筑牢人民币信用根基置于人民币国际化法制建设的核心位置并贯彻始终。为此,我国尤其应加强货币政策法制以维护人民币币值稳定,加强对境内外人民币财产的法律保护,以使人民币取信于国际社会,实现人民币国际化。The realization Renminbi(RMB)internationalization is contingent on the legal system that satisfies the needs of RMB internationalization.The identification and construction of such a legal system need the setup of the jurisprudence benchmark and the core of legal construction confirmed by the benchmark.The jurisprudence benchmark and core for the legal construction for RMB internationalization should be found in the essence of RMB internationalization due to the fact that the legal system needed by RMB internationalization is the reflection of essential requirements of RMB internationalization at law.At the present time of credit standard of money,RMB is of national credit in nature,and RMB internationalization relies on the voluntary acceptance from international community other than legal constraint,thus RMB internationalization is the internationalization of RMB credit in essence.Neither metalism nor state theory of money can explain this phenomenon,nor can they solve the legal issues arising from it.Societary theory of money which stresses social choices could explain the phenomenon of international use of money,and thus should constitute the jurisprudence basis for the legal construction of RMB internationalization,but should be developed.For sake of this,China should take the safeguarding of RMB credit as fingerpost for legal construction of RMB internationalization,and put the consolidation of RMB credit as priority and carry that out in the whole process of legal construction of RMB internationalization.For this reason,China should improve the rule of law governing monetary policy to maintain monetary stability,strengthen the protection of RMB assets at home and abroad so as to win the trust from the international community for RMB and thus to promote RMB internationalization.
