摘 要:经济法调整对象应当是国民经济关系而不是经济关系,这种关系具有社会连带性,体现为两种形态:一是不特定主体之间相互协作的团结型连带;二是由特定主体间形成的中心结构和不特定主体间形成的外围结构组成的辐射型连带。规制国民经济关系的宏观调控法和市场规制法分别对应的是上述两种连带类型。两种不同的社会连带类型可以在国民经济的不同领域中观察到,例如团结型连带体现在地区间协调关系、产业间协作关系、企业间合作关系等方面;辐射型连带则体现在产品间关联关系和行为复合性关系等方面。The entities of which economic laws attempt to adjust should refer to the relationships of the national economy rather than the economic relationships, these relationships possess features of social connections. The social connections in the relationships of national economy contain two forms. One is the solidary pattern of connections in the mutual collaboration between unspecified subjects, and the other is the radial pattern consisting of a central structure formed between specific subjects and a peripheral structure formed between unspecified subjects. The macro-control law and the market regulation law correspond to the two types of connections mentioned above. The two different patterns of social connections can be observed in different areas of the national economy. As such, solidary connections are embodied in the relations of inter-regional coordination, inter-industry cooperative and inter-enterprise collaborations, while radial connections can be manifested in the relations of inter-product association and behavioral complexity.
