我国临时仲裁裁决撤销制度的建构

摘　　要：尽快建立符合中国国情的临时仲裁裁决撤销制度是推进我国仲裁制度改革完善与仲裁事业发展的大事,也是我国打造国际仲裁中心的基础性工作。未来我国临时仲裁裁决撤销制度应以保障当事人切身利益为基本价值取向,充分实现当事人权益救济、仲裁司法监督以及保障国家有效行使司法主权的功能。作为直观体现保障国家有效行使司法主权以及维护本国当事人利益的临时仲裁裁决撤销管辖权应以"仲裁地"为判断归属。对于临时仲裁裁决撤销制度的核心——撤销事由的选择应基于利益平衡进行本土化合理选择,当事人举证与法院主动查明的协同作用模式更为符合我国国情以及仲裁国际化的客观需求。而已为中国法院撤销的临时仲裁裁决,其他国家或地区不应再对此项裁决予以承认和执行。The establishment of the setting aside of the Ad Hoc Arbitral Award in accordance with Chinese national conditions as soon as possible is a major event to promote the reform and improvement of our arbitral system and the development of arbitration,and it is also the basic work for China to build an international arbitration center.In the future,the setting aside of the Ad Hoc Arbitral Award should take the protection of the vital interests of the parties as the basic value orientation,realize the relief of the rights and interests of the parties,the judicial supervision of arbitration and the effective exercise of judicial sovereignty by the state.As an intuitionistic embodiment of the effective exercise of judicial sovereignty by the state and the protection of the interests of the parties,the basis for the setting aside of the Ad Hoc Arbitral Award should be based on the"seat of arbitration".The choice of the cause of annulment,which is the core of the setting aside of the Ad Hoc Arbitral Award,should be based on the balance of interests.The synergy mode identified by the parties and the court is more in line with the national conditions of our country and the objective needs of the internationalization of arbitration.An Ad Hoc Arbitral Award set aside by a mainland Chinese court shall no longer be recognized and enforced by other countries or regions.
