摘　　要：在国家治理与社会治理并行的治理结构中,民事政策和私权自治的冲突与共生不可避免,应立足于中国社会与经济发展实践,廓定民事政策介入私权自治的维度,既要辨明二者的相互作用,也要为二者的共生找到路径;既需要降低民事政策的随意性和弹性,又要厘清民事政策介入的边界。在尊重私权自治本身目的的基础上,将民事政策予以类型化,以有效弥补私权自治的局限性与滞后性,实现国家治理的有机与协调。In the governance structure of parallel national governance and social governance,the conflict and symbiosis between civil policy and private autonomy are inevitable.We must outline the dimension of civil policy intervention in private autonomy based on the practice of social and economic development in China.We should not only identify the interaction between them,but also find a path for the symbiosis of them.It is need to reduce the randomness and flexibility of civil policy,and it is necessary to clarify the boundary of civil policy intervention as well.On the basis of respecting the purpose of the autonomy of private rights,the civil policy can be classified,which can effectively make up for the limitation and lag of private autonomy,To achieve the organic and coordinated governance of the state.
