合宪性解释适用分析

摘　　要：全国人大法律委员会更名为宪法和法律委员会,使我国合宪性审查在机构和职责安排上实现了突破。合宪性审查制度需要关注宪法教义学,尤其是合宪性解释理论。三种合宪性解释规则明确了合宪性解释有两个不同层面的内容,一种发生于真正的宪法案件即合宪性审查或违宪审查中,一种发生在普通案件中。作为法律方法的合宪性解释对应的是普通诉讼中的合宪性解释,作为宪法方法的合宪性解释对应的是违宪审查中的合宪性解释。梳理合宪性解释理论的发展脉络和我国相关研究成果,厘清相关概念和规则源流,明晰其作为解释规则的内涵和实践,对比我国合宪性审查与他国违宪审查的差异,指出合宪性解释理论在我国合宪性审查的“前端”与“后端”的适用可能。The establishment of the Constitution and Law Committee has made a breakthrough in the organization and responsibility arrangement of constitutional review in China.The constitutional review system needs to pay attention to constitutional doctrines,especially the theory of interpretation of constitutionality.The rules of the three interpretations of constitutionality make it clear that there are two different levels of content of it,one occurs in the real constitutional cases,that is,the review of constitutionality or review of non-constitutionality,and the other occurs in ordinary cases.The interpretation of constitutionality as a legal method corresponds to the constitutional interpretation in ordinary litigation,and the interpretation of constitutionality as a constitutional method corresponds to the constitutional interpretation in the unconstitutional review.This paper combs the development of the theory of interpretation of constitutionality and relevant research results in China,clarifies the relevant concepts and rules,clears up its connotation and practice as an interpretation rule,compares the differences between China′s constitutional review and other countries′unconstitutional review,and points out the applicability of the theory of interpretation of constitutionality in the"front end"and"back end"of China′s constitutional review.
