社会企业参与高校办学的法律资格分析

摘　　要：社会企业对社会问题的解决具有先天优势。社会问题频发的背景下,积极借鉴国内外经验,引介社会企业解决社会问题具有重要意义。高等教育作为问题频发的典型领域,社会企业参与高校办学能够更有效地发挥公平、效率、创新功能。并且,在有限的营业自主权下,通过构建收入来源、利润分配限制、剩余资产处置等制度,能更好实现社会企业提高高等教育服务的质量和水平,从而实现社会企业与教育事业的协同发展。Social enterprise has the natural priority in solving social problem.Under the background of social problem occurring frequently,we actively borrow the experience at home and abroad.It has great meaning to introduce social enterprise to solve social problems.Higher education is a typical field with frequent problems.Social enterprise takes part in university running,which can give effective play to the functions of fairness,efficiency and innovation.Furthermore,under the limited business autonomy,through the construction of revenue source and surplus assets disposal system,it will be better to realize social enterprise improving the service quality and standard so as to realize the cooperative development of the social enterprise and educational cause.
