社会秩序规则关照下的体育规则探析

摘　　要：采用文献资料法和逻辑分析法,在对哈耶克社会秩序规则观进行阐述的基础上,对体育规则进行研究。认为,体育规则具有规范性、否定性、普遍性和独立性等特征,并受社会文明程度、科学技术水平、人类自身发展需求等影响。体育规则对体育行为、体育道德观念和体育市场活力均能够产生影响。应借鉴哈耶克的社会秩序规则观建设完善体育规则:明确体育规则结构,实现体育的规则之治;营造体育规则的文化氛围,增强规则意识;强化本土体育规则,提高体育行业独立运行的能力;实现多元化的权力配置,规避权力异化现象。旨在激发体育法治的内在动力,筑起与体育发展方式协同的体育规则化秩序,对体育强国建设发挥支撑作用。This paper studies sports rules based on Hayek’s social order rules by using the methods of literature and logical analysis.It is believed that sports rules have the characteristics of standardization,negation,universality and independence,and are influenced by the degree of social civilization,the level of science and technology,and the needs of human development.Sports rules can influence sports behavior,sports moral concept and sports market vitality.We can learn from Hayek’s view of social order rules to construct and perfect sports rules.We should make clear the structure of sports rules and realize the management of them;create a cultural atmosphere and enhance the awareness of rules;strengthen local sports rules and improve the ability of sports industry to operate independently;realize diversified power allocation and avoid the phenomenon of power alienation.The purpose of this paper is to stimulate the internal power of sports rule of law,build a sports regularization order in coordination with the sports development mode,and play a supporting role in the construction of sports power.
