外观设计专利申请策略的思考

摘　　要：在工程机械行业,人们对产品外观设计追求也越来越高,而对外观设计专利申请的布局也会有更高要求。在专利检索过程中,发现某企业在美国申请外观设计专利的一种策略,通过对此申请策略的进一步分析思考,包括查阅法律法规、实际案例等,分析了局部外观设计的保护、请求保护色彩对保护范围的影响、禁止重复授权原则等情况。提出了在此情况下,针对我国外观设计专利的申请策略,可以根据产品和设计方案的具体特点,选择申请部件的外观设计专利、采用相似外观设计的申请制度等,进行外观设计专利的布局,以获得更大的保护范围。In the construction machinery industry,people's pursuit of product design is higher and higher,and the layout of design patent application will also have higher requirements.In the process of patent search,we found a kind of strategy for an enterprise to apply for a design patent in the United States.Through further analysis and consideration of this application strategy,including consulting laws and regulations,actual cases,etc.,the protection of local design,the influence of requested protection color on the scope of protection,and the principle of prohibiting duplicate authorization are analyzed.In this case,according to the specific characteristics of the product and design scheme,we can choose the design patent of the applied parts,adopt the application system of similar design,etc.,and carry out the layout of the design patent,so as to obtain a greater protection scope.
