县域法治评估机制的演进、反思与更新

摘　　要：法治评估、特别是县域法治评估的萌生和发展顺应了法治生成和扎根的时代主轴,但过度量化的趋势使得浅表化、形式化甚至政绩化的隐忧浮现。究其症结在于对法治评估作为知情权、评价权和监督权的权利根据及其反馈、监督、激励等功能定位存在认识盲区,应促使县域法治评估在科学、民主和实质评估的根本基准上以评估指标完善为重心,以调查研究为先导,传导和输入法治方略与民众需求,更为深度地聚焦法治运行及其与社会生活对接兼容中的关键细节和薄弱环节,在依法执政、依法行政、依法监督和依法自治等四个方面在地化精准选取和设定更具适切性的评估对象、事项及其指标、权重,增强县域法治评估对健全法治运行机制和法治实现机制的指引功效与促进实效。The emergence and development of the evaluation on the rule of law,especially at the county level,strikes the deep chord of this law-based era.However,the tendency of over quantification may bring about the worries of superficiality,formalization and excessive pursuit of political achievements.It should be recognized that the quantitative evaluation on the rule of law is based on the right of the public to know,to evaluate and to supervise.This kind of evaluation has the functions of feedback,supervision and encouragement.The quantitative evaluation on the rule of law at the county level should be more scientific,democratic and substantive.If we want to improve this evaluation mechanism,we should grasp the key point of improving the evaluation index design,conduct investigations in advance and attentively respond to the needs of the public before implementing the principles of the rule of law.We should also focus on the key links and weak points in the connection between law and society.The evaluation objects of ruling according to law,administration according to law,supervision according to law and autonomy according to law should be distinguished in designing evaluation indexes and their proportions,so as to strengthen the guidance and promoting role of evaluation mechanism of the rule of law at the county level in perfecting the operating and implementing mechanism of law.
