环境污染评价标准与环境污染犯罪定罪原则研究

摘　　要：若要以刑法为依据打击环境污染犯罪,必须在法律规定的概念上制定相关的定性定量的标准,只有在标准明确、定性定量清晰的前提下,才能够根据环境犯罪的组成要件科处刑法。为此,文章首先将模糊聚类最大矩阵原理和模糊决策中的综合评判法结合起来,组建模糊聚类法,实现对环境污染程度的最优评判。在此基础上,对污染因子的类别进行划分,为环境污染犯罪定罪提供有效的理论依据。最后,结合相关的环境污染评价标准对环境污染犯罪的具体定罪原则展开探析。In order to crack down on environmental pollution crimes based on criminal law,relevant qualitative and quantitative standards must be formulated in the concept of legal provisions.Only on the premise of clear standards and clear qualitative and quantitative requirements can criminal law be dealt with according to the constituent elements of environmental crimes.The paper first combines the principle of fuzzy clustering maximum matrix with the comprehensive evaluation method in fuzzy decision-making,and constructs the fuzzy clustering method to achieve the optimal evaluation of environmental pollution degree.On this basis,the classification of pollution factors is divided to provide an effective theoretical basis for the conviction of environmental pollution crimes.Finally,this paper analyzes the specific criminalization principle of environmental pollution crime in combination with relevant environmental pollution evaluation standards.
