摘　　要：司法改革之于诚信政府建设的功能研究,意在从司法改革的视角寻求司法和诚信政府建设之间的功能性勾连。司法"去地方化"改革之于诚信政府建设的功能实质,在于通过提升司法权的独立运作以及对于行政权的制约能力,从而促进其对于诚信政府的形塑能力;"基本解决执行难"行动则通过发挥清单式治理下具有失信惩戒作用的失信被执行人名单制度以及司法系统与其他系统的协作化运行来促进诚信政府建设;作为司法改革之规范载体的规范性司法文件,通过"文件政治"这一既有政治科层式路径以及司法裁判与执行的依据选择而对行政系统的诚信建设产生影响。但是以上三种司法改革的进路,不管是在司法裁判功能的本体意义上,还是在"司法-行政"的权力结构视角上,抑或在新制度供给和制度效能的有限性以及失信黑名单制度的成熟度上,都对诚信政府建设具有一定的功能限度。因此需要加以完善,共助诚信政府建设。The research on the function of judicial reform in the construction of credible government is toseek the functional connection between justice and the construction of credible government from the perspectiveof judicial reform.The functional essence of judicial"delocalization"reform is to promote its ability to shape acredible government by enhancing the independent operation of judicial power and its ability to restrictadministrative power.The campaign of"basically solving the difficulty of judicial execution"also promotes theestablishment of a credible government through the use of the list of untrustworthy persons subject topunishment system and the coordinated operation of the judicial system with other systems under the checklistgovernance.As the normative carrier of judicial reform,the normative judicial document have an impact on theintegrity of the administrative system through the existing political bureaucratic path of"document politics"andthe choice of the basis for judicial judgment and execution.However,all the three approaches to judicial reformmentioned above have a certain functional limit to the construction of credible government,whether in theontological sense of the judicial adjudication function,or from the perspective of the"judicial-administrative"power structure,or the limited supply and effectiveness of the new system,and the maturity of the untrustworthyblacklist system.Therefore,more needs to be done to help build a credible government.
