现代产权理论视域下农村土地“三权分置”的改革研究

摘　　要：农地“三权分置”的制度设计是对农地承包权的继承与发展。基于现代产权理论的视角,分析了农地“三权分置”改革的动因,提出其未来的改革方向,即坚持土地集体所有制,平衡三权主体的合法利益,强化经营权流转监管,推动农地流转与农地开发,促进农业的现代化发展。The system design of“three rights division”about farmland is the inheritance and development of farmland contract right.Based on the perspective of modern property right theory,this paper analyzes the motivation of the reform of“three rights division”of farmland,and puts forward its future reform direction.In order to promote the modernization of agriculture,these measures are to adhere to the collective ownership of land,balance the legitimate interests of the three right subjects,strengthen the supervision of the transfer of management rights,promote the transfer of agricultural land and agricultural land development.
