摘　　要：森林具有重要的生态功能,有必要对森林类犯罪回应生态诉求的现状开展研究,中国刑法设定了7种森林类犯罪,中国森林类相关罪名的刑法设定与司法实践具有司法常态化、地区差异化、罪名差异化3个特征。但目前森林类犯罪的设定无法完全回应中国对生态保护的需要。应注重森林类犯罪行政执法与刑事司法的衔接,设定破坏生态环境罪等措施来优化罪名设定,更好地回应生态保护的诉求。Forest has important ecological function.It is necessary to study the current situation of forest crimes responding to ecologi⁃cal demands.China's criminal law had set up seven kinds of forest crimes.The criminal law setting and judicial practice of forest-relat⁃ed crimes in China have three characteristics:Judicial normalization,regional differentiation and crime differentiation.However,at present,it can not fully respond to the needs of ecological protection in China.We should pay attention to the connection between ad⁃ministrative punishment and criminal punishment for forest crimes,and set up the crime of destroying the ecological environment,so as to optimize the establishment of charges and better respond to the demands of ecological protection.
