探险型特殊旅游项目安全问题背后的《旅游法》--以“2019·10·1马家沟氢气球事故”为切入点

摘　　要：近年来,探险型特殊旅游项目迅速兴起,同时也带来了许多安全问题。以“2019?10?1”马家沟氢气球事故为切入点,结合《旅游法》以小见大地分析出了探险型特殊旅游项目安全事故发生的原因概括起来有二:其一经营者、景区、政府、游客等主体违反《旅游法》等有关法律规定,其二《旅游法》等有关法律规定本身尚存在问题。探险型特殊旅游项目安全事故发生造成的后果严重,防止探险型特殊旅游项目安全事故的发生成为旅游工作的重中之重。分析原因来对症下药发现:健全的法治是防止探险型特殊旅游项目安全事故发生的最佳良药。In recent years,the rapid rise of special adventure tour projects has caused many problems of security.Taking the Majiagou Hydrogen Balloon Accident on Oct.12019 as an example and basing the analysis on Tourism Law,this paper analyzes the reasons for the accidents as the following:firstly,the tour operators,scenic spots,government and tourists violated legal provisions in the Tourism Law;secondly,the Tourism Law is not flawless.The serious consequences of the accidents must draw the attention and the top priority must be given to taking measures to prevent the accidents.It is found that sound rules of law are the best and final prevention against the accidents in special adventure tour projects.
