摘　　要：《民法典》总则关于知识产权的界定属于典型的说明性规范,立法旨意采取知识产权绝对法定原则。《民法典》第440条第5项和第444条形成两个完全规范,在办理知识产权质押登记时需要依照主管部门的规范性文件进行。《民法典》知识产权法律规范集中体现在合同编第二分编第二十章技术合同中,在具体制度设计方面的创新主要表现在技术转让合同与技术许可合同的分类界定上和适用范围拓展上。《民法典》第1019条第2款的肖像作品问题和《民法典》第1027条文学、艺术作品问题,在具体民事责任判定上采取动态系统论较妥。《民法典》第1185条规定了知识产权的惩罚性赔偿,在知识产权单行立法中,采取融合论才切合该条的立法旨意。The definition of intellectual property in the general provisions of the Civil Code is a typical illustrative norm,and the legislative intent adopts the principle of absolute legality of intellectual property.Article 440,item 5 and article 444 of the Civil Code form two complete norms.The registration of intellectual property pledge shall be carried out in accordance with the regulatory documents of the competent authorities.The legal norms of intellectual property in the Civil Code are embodied in Chapter 20 of the second part of the contract.The innovation in the specific system design is mainly reflected in the classification and definition of technology transfer contract and technology license con⁃tract and the expansion of the scope of application.It is better to adopt the dynamic system theory in the judgment of specific civil liability for the issue of portrait works in the second item of article 1019 of the Civil Code and the issue of literary and artistic works in article 1027 of the Civil Code.Article 1185 of the Civil Code stipulates the punitive dam⁃ages of intellectual property.In the separate legislation of intellectual property,the fusion theory is suitable for the leg⁃islative purpose of this article.
