商品状况改变后再销售中商标权用尽规则的适用问题研究

摘　　要：商标权用尽规则对商标权人在已售商品上行使商标权加以限制,旨在协调商标权与所有权并存于同一商品所导致的权利冲突,保障商品自由流通。经营者将商标权人合法投放市场的商品经重新包装、加工、翻新后使用原商标再行销售的行为,会破坏商标与商品之间的对应关系,有损商标的来源识别和品质保证功能,因而不能必然适用商标权用尽规则;但在商品未发生实质性改变且商品的真实信息被充分披露的前提下,适用商标权用尽规则并不违背相关理论和制度初衷。The rule of exhaustion of trademark rights guarantees the free circulation of goods by restricting the trademark rights of trademark owners on their sold goods and coordinating the rights conflicts caused by the coexistence of trademark rights and ownership.The business operator′s act of repackaging,processing and renovating the goods legally put on the market by the trademark owner and then selling them with the original trademark will destroy the corresponding relationship between trademarks and commodities,and impair the function of source identification and quality assurance of trademark,thus face the obstacles to the application of trademark exhaustion rules.Under the premise that the commodity has not changed substantially and the true information of the commodity is fully disclosed,the application of trademark exhaustion rule does not violate its theoretical basis and original intention of the system.
