摘 要:有关人工智能的研究很早便涉及法律判断这一应用领域。早期,各国学者立足于知识表示学习模型研究其对法条及案例的演绎推理判断。而随着机器学习模型的兴起,算法模型基于“分类问题”的优化成为了主流。人工智能在法律判断领域的应用及其发展,无疑会降低法律适用的“人治”部分,提升司法效率。但以当前的技术水平,人工智能还远远不能完全替代人在法律判断领域的职能。基于各国研究并结合我国国情梳理当前研究的不足,将有助于推动人工智能在法律判断领域的应用。In the research of artificial intelligence,the application of legal judgment is a topic with a relatively long history.In the early days,scholars from all over the world studied the deductive reasoning judgment of laws and cases based on the knowledge representation learning model.With the rise of the machine learning model,the optimization of the algorithm model based on“classification problem”has become the mainstream.The application and development of artificial intelligence in legal judgment will undoubtedly reduce the“rule of man”part of the application of the law and improve judicial efficiency,but with the current technical level,it is far from being able to completely replace the function of human beings in the field of legal judgment.Based on the research of various countries and combined with national conditions,China should sort out the shortcomings of the current research and promote the development of artificial intelligence in the field of legal judgment.
