制度适应理论视野下的土地征收冲突与基层治理实践——以长沙市高新区为例

摘　　要：征地冲突对社会和谐与稳定有极大的负面影响,因此,如何减少和化解征地冲突是学界关注的重点,也是基层治理面临的重大挑战。运用制度适应理论对长沙市高新区的征地实践工作进行分析发现,其制度文本与地方情境之间存在较大差距,埋下了征地冲突的隐患。为此,该地基层政府通过基层治理实践,弥合二者之间的鸿沟,短期内有效减少了冲突,提高了征地效率,但从长远来看,制度弹性被进一步拉大,会对征地的严肃性和公正性造成冲击。其政策启示是:一方面,政府要进一步完善征地制度文本,保障政策威信;另一方面,也需重视情境性与动态性,灵活实施具体策略,科学组合治理工具。通过双向着力,真正做到依法行政,实现更有效的基层治理以解决征地冲突问题。Land expropriation conflicts have a great negative impact on social harmony and stability.Therefore,how to reduce and resolve land expropriation conflicts is one of primary concerns of the academia,and also a major challenge for grass-roots governance.This paper applies the theory of institutional fit to analyze the land expropriation practice of Changsha High-tech Zone.It is found that there is a big gap between the institutional text and the social situation in Changsha High-tech Zone,which is the potential risk factor for the outbreak of land expropriation conflict.Therefore,through grass-roots governance practice,the local grass-roots government takes measures to bridge the gap between the institutional text and the social situation.Along with these measures,conflicts can be reduced and the efficiency of land expropriation can be improved in the short run.But in the long run,the institutional flexibility will be further expanded,which will impact the seriousness and fairness of the land expropriation text.From the perspective of institutional fit theory,this paper proposes the policy implications that the government should on the one hand,further improve the policy text to ensure the prestige of the policy,and on the other hand,attach importance to the situation and dynamism to flexibly implement the specific strategies and scientifically combine the governance tools.Through all of these,the government can implement the administration according to law,so as to achieve more effective grass-roots governance and solve the conflicts of land expropriation.
