摘 要:互联网信贷监管新规是对治理互联网信贷乱象的经验总结,更是规范和促进互联网信贷行业持续健康发展的制度创新。大数据技术加持下客户渠道与风险定价的融于一体,显著地提升了互联网信贷的风险控制能力,而大数据风险控制模式下对数据、场景、技术进步的依靠又向金融监管当局提出了如何应对信贷环节分工拆解的重大挑战。新规回应了互联网信贷的技术创新,在肯定互联网信贷业务环节流程分散的基础上,明确了信贷主体必须保持对风险决策与控制的自主性,实现合作各方权责的适当分配。当然,新规中存在的主体监管偏见、核心业务界定凌乱、联合贷款规则适用性差等问题尚需深入进一步考量。New regulations of internet credit is not only the summary of regulating experience,but also the institutional innovation to regulate and promote internet credit industry.With the assistance of big data technology,Internet credit industry has integrated customer channel with risk pricing,which has significantly improved the risk management.However,in the big data risk management mode,internet credit industry deeply depends on data,context and technological progress.How to deal with division of credit business process properly challenges regulatory authority.New regulations have responded the technology development of internet credit.Based on the recognition of internet credit business process division,new regulations have emphasized the autonomy of credit subject for risk decision and risk management.New regulations also have reasonably allocated rights and liabilities of cooperation parties.However,in new regulations there still exists such problem sasre gulatory prejudice based on different subject,unreasonabledefinitionof core business,in applicability of some joint loanrules.Afurther research for the solution of those problemsis unavoidably necessary.
