摘　　要：法治化路径是海南自由贸易港自由贸易账户制度构建的关键因素。目前海南自由贸易港自由贸易账户制度法治化路径探索在实践中存在国家事权交叉难以下放、自由贸易账户制度属于中央立法权范畴以及账户监管制度欠完善等主要难题。海南自由贸易港自由贸易账户制度构建应坚持"事权法治制度环境一体化"的方略和路径、"为改革调法"的核心理念、"立改废释并举"的方法论,破解上述难题,培育法治化营商环境,实现贸易自由化目标。建议采取创新机构以明确事权分配、特别授权以完备法律体系以及强化监管以实现风险管控等具体法治化路径。The path of legalization is the key factor for the establishment of free trade account in Hainan Free Trade Port.At present,there are some specific problems in the practice of the legalization of free trade account system in Hainan Free Trade Port,such as the decentralization of free trade account’s overlapping administrative power,the category of central legislative power and the inperfect supervision system.In order to solve these problems,cultivating a legal business environment and achieve the goal of trade liberalization,the free trade account system of Hainan Free Trade Port should adhere to the strategy of"integration of administrative power,rule of law,institution and environment",the core concept of"adjusting law for reform",and the methodology of"simultaneous development of establishment,reform,abolition and interpretation".The specific measures are as follows:institutional innovation to clarify the distribution of administrative power,special authorization model to build a complete legal system and strengthening supervision to achieve risk control.
