简析《民法典》基本原则及人民性的立法表达

摘　　要：伴随中国特色社会主义法治体系的逐渐形成和完善,法治环境以及法律框架的初步成体系越来越完备。我国现存国家法律法规共有1109部,但民法与群众的关系最为密切。《中华人民共和国民法典》的诞生具有划时代意义,是我国法治建设的一项重要举措,也是民之所向、众望所归。《民法典》作为“社会生活的百科全书”,运用了1260个条文对一个普通自然人从衣食住行到生老病死的各项权利和义务作了尽可能详细的解答。《民法典》的诞生并非一蹴而就,经历了社会的发展和时代的更迭,其作用体现在社会稳定和人民生活的方方面面,尤其是人民性的立法表达更值得深入探究。With the gradual formation and improvement of the socialist legal system with Chinese characteristics in China,the initial legal ramework are becoming more and more complete and enforcement of 1109 existing laws and regulations,It is indicated that the construction of the rule of law in China has made a great progress.The promulgation of the Civil Code of the People's Republic of China is of epoch-making significance.China's Civil Code,in which 1260 articles is included,explains in as much detail as possible the rights and obligations of an ordinary natural person,which can be taken as an encyclopedia of social life.The birth of the Civil Code was not achieved overnight.It has experienced the development of society and the change of times,especially the legislative expression of affinity to the people is worth in-depth study.
