民法典精神损害赔偿条款对著作人格权的适用研究

摘　　要：《中华人民共和国民法典》确立了“三位一体”的精神损害赔偿制度,其第1183条第1款确立了侵害自然人人身权益的精神损害赔偿制度,同时成为精神损害赔偿制度的一般条款,为精神损害赔偿条款适用于著作人格权提供了解释空间和适用余地。尽管著作人格权与民法上的人格权存在一定的差异,但二者之间的“血缘关系”是客观存在的:侵害发表权的行为必将会给作者的隐私权造成侵害,侵害署名权的行为不可避免地会使作者的姓名权遭受侵害,而侵害修改权和保护作品完整权的行为也难免会给作者的名誉权带来无法弥补的损失。因此,在立法未能明文规定侵害著作人格权可以提起精神损害赔偿的情况下,通过法律解释将《中华人民共和国民法典》的精神损害赔偿条款适用于著作人格权,既有正当性,又有合法性。既有的法律规定及司法实践也为这一结论提供了基础。The Civil Code of the People’s Republic of China has established a trinity model of mental damage compensation.The first paragraph of Article 1183 establishes the system of mental damage compensation to the rights and interests of natural persons,and becomes the general clause in the system of mental damage compensation,which provides more possibilities of interpretation and application of the mental damage compensation clause for the personality right of copyright.Although there are some differences in personality rights between Copyright and Civil Law,they are related in the following points:once the publication right is infringed,the author’s privacy right will be affected,so is the relationship between authorship right and the right of name.Similarly,the infringement of the revision right and the right of integrity will inevitably cause irreparable damage to the author’s reputation right.Therefore,under the background that the legislation fails to stipulate explicitly that the infringement of copyright personality right applies to mental damage compensation,it is both legitimate and reasonable to apply the mental damage compensation clause of The Civil Code of the People’s Republic of China to copyright personality right through legal interpretation.China’s existing legal provisions and judicial practice also provide basis for the above conclusions.
