摘　　要：法律规范是司法审判活动得以开展的前提和依据,立法应当充分满足司法的规则需求。但我国法律体系一方面无法为法院提供充足的审判依据,另一方面又对法院自行制定的司法规则缺乏实际规制,因而造成了法律的创制与适用之间的断裂。从组织社会学的角度分析,该问题的产生是由于立法组织在投入活动上的缺陷、司法组织在达标与合法性之间的平衡,以及立法、司法组织在功能重合下的结构趋同所导致的配合失灵。因此,为了破解困境,既需要利用新兴技术来完善立法组织建设、畅通立法投入活动,也需要立法机关在尊重法院达标需求的基础上对司法规则进行类型化治理,重塑我国法律创制与司法适用之间的动态衔接机制。Legal norms are the premise and basis of judicial activities,and legislation should fully meet the needs of judicial rules.However,on the one hand,our legal system can not provide sufficient trial basis for the court,and on the other hand,it lacks practical regulation on the judicial rules made by the court itself,resulting in the fracture between the creation and application of the law.From the perspective of organizational sociology,this problem results from the defects of the legislative organization in its input activities,the balance between the standard and legitimacy of the judicial organization,and the coordination failure caused by the structural convergence of the legislative and judicial organizations under the overlapping functions.Therefore,in order to solve the dilemma,we should employ the emerging technologies to improve the construction of legislative organizations and smooth the legislative input activities,and also need the legislatures to carry out the type governance of judicial rules on the basis of respecting the requirements of the court to meet the standards,so as to reshape the dynamic connection mechanism between law creation and judicial application in China.
