摘　　要：近年来干旱区环境犯罪案件频发,严重破坏干旱区生态环境。一直以来,由于干旱区环境犯罪刑事政策的阙如,导致对干旱区环境犯罪没有针对性的政策的指引,刑法规制乏力,构建干旱区环境犯罪刑事政策迫在眉睫。干旱区环境犯罪刑事政策构建的理论基础,要从刑事政策和环境政策两个方面着手,在刑事政策上吸收宽严相济的精神,在环境政策上采纳“两山论”的精髓。干旱区环境犯罪刑事政策的实际司法适用,其主要是修正干旱区环境犯罪的保护法益,引导选择符合干旱区实际状况的空白规范,并且倡导在因果关系判断上适用疫学因果关系理论。在风险社会的背景下,干旱区环境犯罪刑事政策也要进行相应的改变以应对风险社会的威胁,包括提倡干旱区环境犯罪治理早期化,针对干旱区生态环境脆弱的特点完善罪名设置,并且设置刑罚辅助措施以促进干旱区生态环境恢复。In recent years,environmental crimes have occurred frequently in arid areas,seriously damaging the ecological environment in arid areas.For a long time,the lack of criminal policy for environmental crimes in arid areas has led to the lack of targeted policy guidance for environmental crimes in arid areas and the lack of criminal regulation in criminal law,so it is urgent to construct criminal policy for environmental crimes in arid areas.The theoretical basis of the criminal policy construction of environmental crimes in arid areas should be from two aspects:the criminal policy and the environmental policy,the spirit of tempering justice with mercy should be absorbed in the criminal policy,and the essence of"two mountains theory"should be adopted in the environmental policy.The actual judicial application of the criminal policy of environmental crimes in arid areas is mainly to amend the legal interests of environmental crimes in arid areas,guide the selection of blank norms in line with the actual situation in arid areas,and advocate the application of phylogenetic causality theory in the judgment of causality.In the context of risk society,the environment in arid areas crime criminal policy also must carry on the corresponding change in response to the threat of risk society,including early advocate environmental crime control in arid areas,according to the characteristics of the fragile ecological environment in arid areas perfect crime Settings,and set up the penalty auxiliary measures to promote ecological environment restoration in arid areas.
