监察执法中的公安机关职能配合义务

摘　　要：在监察执法中,公安机关基于法定职能直接承担的监察配合义务无需以监察机关的提请配合为前提。在公安机关、监察机关各自执行职务,监察机关办理公安机关或者警察职务违法和职务犯罪案件,公安机关协助监察机关办理职务违法和职务犯罪案件等情形下,只要公安执法与监察执法产生了具体关联性,即可自行启动公安机关职能配合义务。During the supervisory organs’law enforcement,the public security organs shall directly undertake the functional obligation to cooperate and the supervisory organs’request isn’t a necessary premise.In circumstances when the public security organs and the supervisory organs are respectively performing the statutory duties,the supervisory organs are handling the illegal acts and crimes committed by public security organs or police officers taking advantage of their duties,or the public security organs are assisting the supervisory organs in solving illegal acts and crimes committed by those taking advantage of their duties,the public security organs’functional obligation to cooperate with the supervisory organs shall automatically start as long as there’s a specific correlation between the public security organs’law enforcement and the supervisory organs’law enforcement.
