《民法典》视阈下公安工作与民事权利保护

摘　　要：《中华人民共和国民法典》作为社会生活的百科全书,其颁布与实施必然对公安机关警察权力与公民权利之间的关系产生新的影响。《中华人民共和国民法典》不仅规定了公安机关应承担接受提存、高空抛物时责任人的调查、工作中知悉的个人信息保护等法定义务,还为公安刑事执法、行政执法、履行法定义务提供了基本的行为规范依据,因此,公安机关民警需要更新观念,加强学习培训,提升履职尽责的能力和水平。The"Civil Code of the People’s Republic of China",as an encyclopedia of social life,its promulgation and implementation will inevitably have a new impact on the relationship between public security organs’police power and civil rights.The"Civil Code"has not only stipulated that the public security organs shall undertake the statutory obligations to accept application for subject matter in escrow,investigate people who intentionally throw objects from high-rise buildings,and protect personal information acquired in the work.It has also provided a basic code of conduct for public security organs’criminal law enforcement,administrative law enforcement,and their fulfillment of statutory obligations.Therefore,the police officers in public security organs must innovate the ideas,put more emphasis on study and training,and endeavor to improve the ability and level in fulfillment of their duties.
