论宅基地使用权流转之身份性淡化

摘　　要：我国现行宅基地使用权只能在农村居民之间流转,其流转表现出明显的身份性,引发大量法外隐形流转、宅基地闲置等问题。随着新时代城乡一体化进程的推进和农民对宅基地财产性收益的迫切需求,身份性限制成为宅基地使用权流转的障碍。宅基地使用权流转身份性之淡化存在立法基础和司法基础,宅基地使用权流转的身份性应当被淡化。立法应回应宅基地“三权分置”政策,构建宅基地使用权公示制度、有偿使用制度和有期限使用制度,淡化宅基地使用权流转中的身份性,回归宅基地使用权的私权本质。China’s current right to use homestead can only be transferred among rural residents,and its transfer shows obvious identity,giving rise to a large number of extrajudicial invisible circulation,idle homestead bases and other problems.With the progress of the integration of urban and rural areas in the new era and the urgent demand of farmers for the property income of homestead,the restriction of identity becomes an obstacle to the transfer of the right to use homestead.The identity of the transfer of the right to use the homestead has a legislative basis and judicial basis,and the identity of the transfer of the right to use the homestead should be diluted.The legislation should respond to the policy of“Three-Rights Separation”of homestead and construct the public system of the right to use the homestead.We should construct and improve the paid use system and time-limited use system.Relevant laws should desalinate the identity of the right to use the homestead in circulation,which is conducive to make the homestead use right return to its essence of private right.
