高校校规设定开除学籍处分的权界及其规制——以32所教育部直属一流大学建设高校为例

摘　　要：高校开除学籍处分纠纷是一个颇受社会关注的问题,而这与高校校规设定开除学籍处分密切相关。通过观察和比较32所教育部直属一流大学建设高校的校规中关于开除学籍处分的规定,发现校规之间在具体内容上差异较大,因此,提出高校校规设定开除学籍处分的权界问题。一方面,高校享有通过制定校规设定开除学籍处分的权力;另一方面,这一权力是有界限的,主要受到合理行政原则的限制。为此,从实体和程序方面提出了对高校设定开除学籍处分权的规制路径,促进依法治校工作的深化,推进高等学校治理体系和治理能力的现代化建设。The dispute over expulsion from university is an issue of great concern to the society,which is closely related to the punishment of expulsion set by the university rules.By observing and comparing the regulations of 32 first-class universities directly under the Ministry of Education on the punishment of expulsion,it is found that there are great differences in the specific contents between the university rules.Therefore,this paper raises the question of the power of setting the punishment of expulsion in university regulations.On the one hand,universities have the power to set the punishment of expulsion by formulating school rules.On the other hand,the power is limited by the principle of reasonable administration.Therefore,from both substantive and procedural perspectives,this paper puts forward approaches for regulating the punishment of expulsion set by the university rules,so as to deepen the university governance according to law,and promote the modernization of university governance system and governance capacity.
