规制治理理论视域下的经济法规制机制——以消费外部性问题为例

摘　　要：在规制治理理论视域下,经济法规制机制是一种基于双向互动、以期实现合作治理的行为模式,其不完全等同于国家为了纠正市场失灵而作出的干预行为,也不是一种传统的命令控制型的规制。在消费外部性问题解决中,经济法规制机制以软法作为补充规范,结合现行硬法规范,通过确立政府规制路径、平衡权义关系和发挥社会中间层力量,整合不同主体所具有的规制能力。消费外部性问题的经济法规制机制包括规制前提、规制核心、规制辅助和规制补充4个层级,分别由确立消费外部性问题的政府规制路径、平衡消费者享有的权利和负担的义务、发挥消费外部性的社会中间层的规制能力、利用软法规范规制消费外部性4部分组成。From the perspective of regulatory governance theory,the regulatory mechanism of economic law is a behavioral model based on two-way interaction to achieve cooperative governance.It is not the same as the intervention by the state to correct market failures,nor a traditional command-and-control regulation.In solving the issue of consumption externalities,the regulatory mechanism of economic law adopts the current hard law and regulation,with soft law as a supplement,balances the relationship between rights and obligations through the government's regulatory path,give play to the power of the middle-level stratum of the society,and integrates the regulatory capabilities of various subjects.Specifically,there are four levels of the regulatory mechanism of economic law on the issue of consumption externalities,including regulatory precondition,regulatory core,regulatory assistance,and regulatory supplement.They consist of the government regulatory path to establish consumption externalities,the balance between consumer's rights and obligations,the regulatory capabilities of the middle-level stratum of the society to give play to consumption externalities,and the soft law to regulate consumption externalities.
